Lucasfilm did not benefit in any way at Tyburn Film Productions Ltd's expense, counsel said to the appeals court there on 3 December 2025, in part because it already possessed rights over Cushing's likeness and an agreement and consent from the Cushing estate to 'resurrect' him as Grand Moff Tarkin. Tyburn contends it earlier made an agreement with the late actor then, at the time, granting the company a veto over any use of his image prior to his 1994 death. That contract concerns a TV series titled 'Heritage of Horror', which never aired. Tyburn further asserts the deal permits it to effectively 'resurrect' Cushing using stand-ins and CGI to ultimately finish the programme then if the actor were to die whilst filming remained in progress...

Irish telecom operator Eircom’s damages lawsuit against BT Group over a public-sector contract must be carefully managed to trial to deal with confidentiality issues and other matters, a UK judge told the parties today. At the High Court in London today, a judge said Eircom’s damages action against BT over a public-sector contract needs tight case management through to trial to address confidentiality and related concerns. Eircom brought the claim after Ofcom in 2020 penalised BT for its behaviour during a tender. Speaking to both sides, Judge Adam Johnson urged them to resolve any confidentiality flashpoints themselves and signalled he had no wish to step in unless it became unavoidable. He also expressed confidence that parties would do everything possible to keep confidential designations to a minimum, noting this was necessary to maintain control over the conduct of the trial. He framed this as the

Justice Richard Arnold granted AstraZeneca leave to appeal and permitted lorries carrying about 175,000 packs of Glenmark’s generics to move on to wholesalers, provided they did not reach pharmacy shelves while the case continued at any point during those interim proceedings. In this way, Glenmark could keep its first-to-market advantage, while causing only minimal detriment to AstraZeneca should the Court of Appeal later be persuaded to issue an injunction against supply. The judge said this approach maintained the status quo with the least possible prejudice to Glenmark’s position overall. The hearing was arranged at short notice, just days after the High Court refused AstraZeneca an injunction to block the diabetes generic from sale while the court considered whether the patents supporting the branded medicine were valid in law. Glenmark, Generics (UK) Ltd and Teva Pharmaceuticals have each begun proceedings in the UK to set...

The EU AI Act adopts a layered regime for AI systems, imposing transparency duties on every model and reserving stricter risk‑management obligations for the most potent ‘systemic’ ones. These obligations are being hammered out through a code of practice intended as a key compliance tool for model providers. Yet that code could prove marginal if models are not correctly classified for systemic risk Under the Act, a model is chiefly deemed systemic when its training consumed more than 10^25 floating‑point operations. According to research institute Epoch AI, several flagship systems have already crossed this line, including: Open AI’s o1 Anthropic’s Claude 3.5 Sonnet Mistral AI’s Large 2 These are commonly viewed as ‘frontier’ models, pushing the limits of this disruptive technology. Nonetheless, recent developments increasingly call into question whether the volume of compute used in the pre‑training stage is the most...

On 10 February 2025, Trump jolted legal and corporate circles with an executive order freezing FCPA enforcement and instructing Attorney General Pam Bondi to reassess and reshape the federal statute’s application. He directed her to strip away ‘excessive barriers to American commerce abroad’ and to ‘prioritise American interests, American economic competitiveness with respect to other nations, and the efficient use of federal law enforcement resources’. Bondi has 180 days initially to implement the directive, with the option to prolong the review by a further 180 days if additional time is required. The order came on the heels of a Bondi memorandum telling prosecutors in the FCPA unit of the Justice Department’s Criminal Division fraud section to target foreign bribery that sustains cartels and transnational criminal organisations. To date, both directives have generated more uncertainty than clarity about what FCPA...

Global Voice Group SA v Republic of Guinea No 22-2100, D DC, 2025 US Dist LEXIS 28564 Telecommunications contract In May 2009, Global Voice Group SA ( GVG) concluded a partnership to furnish Guinea with tools to monitor and levy taxes on international telecommunications traffic. The agreement identified GVG and the Postal and Telecommunications Regulatory Authority of Guinea ( PTRA) as the contracting parties and included an arbitration clause. A dispute followed concerning GVG’s claim for payment of US$103,171,862.66 said to be due under the contract. In December 2016, GVG commenced ICC arbitration in Paris against both PTRA and Guinea. On 18 July 2019, the tribunal awarded GVG in excess of US$21m in damages and fees. Guinea and PTRA challenged the award in the French courts, but in September 2021 the Paris Court of Appeal affirmed it. On 18 July 2022, GVG filed in the...

Article 45 of the DSA Article 45 of the DSA provides that, when significant systemic risks arise under Article 34(1) (which sets out the duty on very large online platforms ( VLOPs) and very large online search engines ( VLOSEs) to identify, analyse, and assess systemic risks), and affect multiple VLOPs or VLOSEs, the Commission may ask those VLOPs and VLOSEs to help draft codes of conduct, with commitments to adopt risk mitigation measures and to report on those measures and their results. The Code of Conduct+ was adopted in this context. VLOPs’ and VLOSEs’ adherence to the Code of Conduct+ can count as a mitigation measure under Article 35 of the DSA; however, participation in and implementation of the Code of Conduct+ does not, by itself, amount to compliance with the DSA ( Recital 104)......

Antitrust CMA fines four banks over £100m after settling government bonds investigation; one bank receives leniency The CMA handed down five distinct infringement decisions, concluding that five banks— Deutsche Bank, Citi, HSBC, Morgan Stanley and the Royal Bank of Canada—violated Chapter I of the Competition Act 1998 by swapping confidential UK government bond information in private online conversations. Citi, HSBC, Morgan Stanley and Royal Bank of Canada resolved the probe and accepted penalties amounting to £104.46m. Deutsche Bank obtained immunity after notifying the CMA of its own involvement in the misconduct. The wrongdoing occurred at different points between 2009 and 2013. These exchanges were conducted via one-to-one Bloomberg chatrooms among a small cohort of bank traders and concerned trading in UK government debt—namely gilts and gilt asset swaps. Shared content covered pricing and other elements of their trading...

Water and Sewerage Authority of Trinidad and Tobago v Waterworks Ltd [2025] UKPC 9 What are the practical implications of this case? This decision clarifies how clause 19.6(c) of the FIDIC 1999 Conditions of Contract (and likewise clause 18.5(c) in the 2017 editions, which is the same) should be read when assessing, after a termination for convenience, whether any other Cost or liability was reasonably incurred by contractors anticipating completion of the Works. The Board of the Privy Council concluded that a contractor’s obligation to pay cancellation fees to a third‑party equipment supplier did not fall within clause 19.6(c), as those liabilities were not reasonably incurred. The outcome was tough yet fair on the facts. Moreover, the judgment hints, at paragraphs 40 to 45, that if the contractor had advanced a sound justification for entering into the agreement and accepting the...

According to a High Court order dated 14 February 2025, Everatt's LLP and Aviva have brought their dispute over the claim to a close through a confidential settlement agreement. Everatt's was bought in 2020 by Axiom Stone Solicitors, a firm that served as a predecessor to Axiom Ince. No terms of the deal were made public. Aviva offered no comment, and a spokesperson for Everatt's could not immediately be reached. The agreement arrives nearly four years after the firm issued proceedings against Aviva in 2021, seeking a payment of up to £478,000 for lost income, together with approximately £150,000 in increased office costs. The firm alleged its lawyers could not see clients, make or receive phone calls, or access documents stored at its Harrow premises in north-west London......

Re X and Y [2025] EWCA Civ 2 What are the practical implications of this case? This judgment carries considerable weight: the Court of Appeal determined that the court lacks power to annul or rescind an adoption order on welfare grounds, regardless of how persuasive the circumstances appear. The court stated that a poor outcome after adoption, and the fact that undoing the order would benefit the adoptee, whether minor or adult, does not justify the judiciary creating a remedy that Parliament has deliberately withheld. It underscores that adoption orders are transformative in nature, possess a unique finality, and are designed to be permanent, enduring for life as though the child were born to the adopter. The ruling aligns entirely with the strong policy position that adoption effects a total, lifelong and irrevocable transfer of parental status. However, where there have been...

This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
