Lucasfilm did not benefit in any way at Tyburn Film Productions Ltd's expense, counsel said to the appeals court there on 3 December 2025, in part because it already possessed rights over Cushing's likeness and an agreement and consent from the Cushing estate to 'resurrect' him as Grand Moff Tarkin. Tyburn contends it earlier made an agreement with the late actor then, at the time, granting the company a veto over any use of his image prior to his 1994 death. That contract concerns a TV series titled 'Heritage of Horror', which never aired. Tyburn further asserts the deal permits it to effectively 'resurrect' Cushing using stand-ins and CGI to ultimately finish the programme then if the actor were to die whilst filming remained in progress...

Irish telecom operator Eircom’s damages lawsuit against BT Group over a public-sector contract must be carefully managed to trial to deal with confidentiality issues and other matters, a UK judge told the parties today. At the High Court in London today, a judge said Eircom’s damages action against BT over a public-sector contract needs tight case management through to trial to address confidentiality and related concerns. Eircom brought the claim after Ofcom in 2020 penalised BT for its behaviour during a tender. Speaking to both sides, Judge Adam Johnson urged them to resolve any confidentiality flashpoints themselves and signalled he had no wish to step in unless it became unavoidable. He also expressed confidence that parties would do everything possible to keep confidential designations to a minimum, noting this was necessary to maintain control over the conduct of the trial. He framed this as the

Justice Richard Arnold granted AstraZeneca leave to appeal and permitted lorries carrying about 175,000 packs of Glenmark’s generics to move on to wholesalers, provided they did not reach pharmacy shelves while the case continued at any point during those interim proceedings. In this way, Glenmark could keep its first-to-market advantage, while causing only minimal detriment to AstraZeneca should the Court of Appeal later be persuaded to issue an injunction against supply. The judge said this approach maintained the status quo with the least possible prejudice to Glenmark’s position overall. The hearing was arranged at short notice, just days after the High Court refused AstraZeneca an injunction to block the diabetes generic from sale while the court considered whether the patents supporting the branded medicine were valid in law. Glenmark, Generics (UK) Ltd and Teva Pharmaceuticals have each begun proceedings in the UK to set...

US District Judge Beryl A Howell – 11 February 2025 minute order In a minute order dated 11 February 2025, US District Judge Beryl A Howell indicated that, while the Kingdom of Spain pursues a petition for a writ of certiorari, it has provided little basis to think the justices will consider whether Spain agreed to arbitrate investor disputes under the Energy Charter Treaty. Judge Howell underscored the DC Circuit’s 2 December 2024 refusal of Spain’s bid for rehearing en banc in litigation brought by renewable energy investors seeking to enforce some US$377m in arbitral awards against Spain arising from set aside economic incentives. The appellate court also declined to revisit its earlier summer ruling that the awards are subject to enforcement......

The refreshed policy raises the quantum of annual LTIP awards for executive directors from 300% to 400% of salary; an initial 450% ceiling was cut following shareholder engagement. Edwards & Others v 2 Sisters Food Group Ltd [2024] Lexis Citation 4356 What are the practical implications of this case? Despite being a County Court decision, this concise judgment will reassure employers confronting comparable employee coronavirus claims. It was striking that the claimants had still not obtained medical or other material supporting causation, nor any proof substantiating the pleaded breaches of duty. While the judge stressed the solicitor’s obligation to investigate properly before issuing proceedings, a more robust investigation would not necessarily have improved the prospects of resisting a summary judgment application if supportive expert opinion was never going to emerge. For a novel coronavirus claim to withstand a summary judgment application, there must be convincing evidence indicating the claimant could not have contracted the virus elsewhere......

The UK Supreme Court unanimously allowed Joseph El‑ Khouri’s appeal, stopping the United States from seeking the London-based trader’s extradition to answer allegations of insider dealing. The justices reversed two lower-court decisions, finding he could not be surrendered because the core of the alleged misconduct occurred in the UK. They observed that the sole act said to have taken place in the US was paying for a middleman’s hotel room in New York, while the locations where any gains were later enjoyed were merely incidental. Delivering the ruling, Justice George Leggatt said the lower courts were wrong to hold that extradition was justified on the basis that the supposed insider dealing was “felt” on US markets. That conclusion, he explained, conflicts with the plain wording of the extradition scheme, which ties “conduct” to where the physical acts were carried out, not to where their...

What is the background to the FCA's policy statement? A pensions dashboard is a secure online platform letting people view all their pensions in one place. DWP Guidance requires trustees of in-scope and FCA‑regulated schemes to have regard to a staged connection timetable: largest schemes by 30 April 2025, smallest by 31 October 2026. A Money Helper-backed government dashboard will be publicly available for connections, with commercial dashboards expected to follow. As private entities may provide these services, robust consumer protections and regulatory safeguards are needed. Therefore, operating a pensions dashboard service ( PDS) is being brought within the FCA’s remit. In Spring 2024, the FCA consulted on the regulatory framework for PDS operators. Firms intending to run a PDS must: be or become FCA authorised obtain the FCA’s permission to undertake the new regulated activity meet the FCA’s requirements for firms undertaking this...

This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
