Lucasfilm did not benefit in any way at Tyburn Film Productions Ltd's expense, counsel said to the appeals court there on 3 December 2025, in part because it already possessed rights over Cushing's likeness and an agreement and consent from the Cushing estate to 'resurrect' him as Grand Moff Tarkin. Tyburn contends it earlier made an agreement with the late actor then, at the time, granting the company a veto over any use of his image prior to his 1994 death. That contract concerns a TV series titled 'Heritage of Horror', which never aired. Tyburn further asserts the deal permits it to effectively 'resurrect' Cushing using stand-ins and CGI to ultimately finish the programme then if the actor were to die whilst filming remained in progress...

Irish telecom operator Eircom’s damages lawsuit against BT Group over a public-sector contract must be carefully managed to trial to deal with confidentiality issues and other matters, a UK judge told the parties today. At the High Court in London today, a judge said Eircom’s damages action against BT over a public-sector contract needs tight case management through to trial to address confidentiality and related concerns. Eircom brought the claim after Ofcom in 2020 penalised BT for its behaviour during a tender. Speaking to both sides, Judge Adam Johnson urged them to resolve any confidentiality flashpoints themselves and signalled he had no wish to step in unless it became unavoidable. He also expressed confidence that parties would do everything possible to keep confidential designations to a minimum, noting this was necessary to maintain control over the conduct of the trial. He framed this as the

Justice Richard Arnold granted AstraZeneca leave to appeal and permitted lorries carrying about 175,000 packs of Glenmark’s generics to move on to wholesalers, provided they did not reach pharmacy shelves while the case continued at any point during those interim proceedings. In this way, Glenmark could keep its first-to-market advantage, while causing only minimal detriment to AstraZeneca should the Court of Appeal later be persuaded to issue an injunction against supply. The judge said this approach maintained the status quo with the least possible prejudice to Glenmark’s position overall. The hearing was arranged at short notice, just days after the High Court refused AstraZeneca an injunction to block the diabetes generic from sale while the court considered whether the patents supporting the branded medicine were valid in law. Glenmark, Generics (UK) Ltd and Teva Pharmaceuticals have each begun proceedings in the UK to set...

It marks the first flagship move of this Commission’s mandate. The ambition is to secure Europe’s leadership in designing, producing and commercialising next-generation technologies, services and clean products, while progressing towards climate neutrality. Although productivity growth has trailed that of other major economies for two decades, the EU retains the ingredients to turn the tide — a skilled labour force, capital, savings and a...

In its closing submissions, the world’s biggest aircraft lessor urged the court to firmly dismiss Fidelis’s contention that it has no obligation to indemnify Aer Cap for losses tied to aircraft left in Russia because of sanctions imposed by the US, UK and EU, following coordinated measures. Mark Howard KC of Brick Court Chambers, for Aer Cap, said that permitting Fidelis to sidestep payment under its contingent liability policy with the lessor would do nothing to advance the objectives of sanctions on Russia in practice. Aer Cap is turning to contingency insurance to recover financial losses linked to the aircraft stuck in Russia. The lessor contends that Fidelis, together with several other participating insurers, must respond for 116 of its aircraft and 15 stand‑alone engines that were “lost” after becoming stranded in Russia in 2022. “ Fidelis are trying to argue that...

Among the latest triggers for reform was the Financial Services and Markets Act 2023 ( FSMA 2023), which scrapped obsolete EU-derived rules and handed watchdogs fresh authority to set requirements that safeguard consumers. The statute also introduced a secondary aim centred on growth and competitiveness. Post- Brexit regulatory change has proved expensive and intricate. As the UK marks five years since Brexit, the Financial Conduct Authority ( FCA) is seeking to explain how it will balance consumer protection with the government’s ambition for financial services to spur economic expansion. Some lawyers caution that mixed messages risk creating uncertainty over supervisory priorities. ‘ Is this really the moment to contemplate a sweeping overhaul of the rulebook?’ asked Sara Cody, counsel in Linklaters LLP’s contentious regulation team. ‘ Firms have only just embedded the Consumer Duty and, before that, were grappling with the vast regulatory fallout from Brexit,’ Cody...

UK financial regulators have come into the government’s firing line. On 29 January 2025, Finance Minister Rachel Reeves lambasted their labyrinthine rules and a shortage of predictability in a keynote address on economic growth. Payments supervision has been picked out by the financial services industry as especially intricate. By certain estimates, compliance swallows almost the entire budget companies ringfence for operational improvements. Fintech is a major expansion prospect for the UK, with payments the strongest strand of fintech investment. Naturally, payments has become a focal point for the government. Reeves, alongside Prime Minister Keir Starmer, wrote to the Payment Systems Regulator ( PSR) in December 2024, outlining their expectations for supporting growth. The PSR’s answer, released on 28 January 2025, is unlikely to appease those who criticise the regulator. While the Financial Conduct Authority ( FCA) was praised by industry for unveiling a bold...

Commission arrangements of the sort agreed between Arnold Clark and Clydesdale in this matter were prohibited by the FCA in 2021. Nonetheless, the court acknowledged that a significant number of car purchases occurred in contexts where those or comparable terms existed or might have applied, or could potentially have been present. The Ombudsman concluded that Arnold Clark recommended to Ms Lewis a Clydesdale finance product (the conditional sale agreement) which formed part of the overall transactional package enabling her to acquire the vehicle, alongside the part exchange of her previous car and a...

Former HM Revenue and Customs tax inspector Simon Emblin, together with lawyers Carl O' Shea and Mark Reid, orchestrated the sale of loan assets to FS Capital Ltd — where Emblin was a director — for what they regarded as 'a fraction of their true value', according to a Court of Appeal judgment handed down on 28 January 2025. O' Shea is a group partner at Hatstone LLC, a boutique Jersey-based law firm, while Reid is a former partner at Gateley Wareing Solicitors, now Gateley Plc. With Emblin, they devised and executed a scheme to exclude the beneficiaries and divert the 'huge commercial opportunity' to themselves, the lower court found. In a concurrence with Justice Sarah Asplin's ruling, Justice Stephen Males noted that this was, in the 'archaic and inaccurate language of equity', 'a fraud on a power', a...

This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
