R (Greyhound Board of Great Britain Ltd) v Welsh Ministers [2026] EWHC 670 (Admin) What are the practical implications of this case? The ruling reinforces the constitutional divide between the courts and the legislature. It explains that the scheme and framework of the Government of Wales Act 2006 (GWA 2006) embody that separation of powers, and that any judicial attempt to recognise and enforce a common law obligation on Welsh Ministers to consult prior to introducing legislation in the Senedd would trespass upon that boundary. This is not a departure from established principle; case law has already upheld comparable rules for lawmakers in Scotland and at Westminster. However, this is the first express confirmation of the position for Welsh lawmakers, and the first time this dimension of the GWA 2006 has been analysed in such depth. The court examined earlier

The solution arrived through the United Nations Compensation Commission (UNCC), a quasi‑judicial body handling mass claims, created under UN Security Council Resolution 687. By addressing environmental harm—most notably via its ‘F4’ claim class—the UNCC set a seminal benchmark shaping how international law and contemporary arbitral panels allocate financial responsibility for wartime ecological devastation. With present-day wars in areas such as Eastern Europe and the Middle East bringing dam breaches, strikes on chemical facilities, and the burning of farmland, the UNCC’s legacy endures as an essential reference point for states, global investors, and companies engaged in post‑conflict arbitration. The F4 claims: Quantifying the unquantifiable Prior to the 1990s, mechanisms in international law for war reparations overwhelmingly favoured property loss, foregone earnings, and bodily injury. The natural world was commonly treated as a mute, non-compensable victim of armed hostilities...

Understanding the farming business as a business Many farms still use long-standing structures that arose by habit, not strategy. Sole traders, informal partnerships and outdated partnership deeds are common. While once effective, such setups can cause major issues around succession, tax planning and involving the next generation. A corporate team can take a fresh, business-led view of the farm, asking: Who owns the land and other critical assets? Who manages daily operations? Who carries the risk and who enjoys the return? What is the enduring plan for succession? From this review, the team can confirm whether the current setup is fit for purpose or if an alternative — for example an updated partnership agreement, a company, a limited liability partnership, or a blended model — would better meet the family’s aims. Tax efficiency through joined-up advice Tax sits at the centre of most

Banking & Finance— February 2024 case round-up Chapman and another company v Celtic Property Developments Ltd [2024] Lexis Citation 104 Security—continued validity of a debenture—estoppel The dispute concerned whether a debenture given to the First Claimant by the Defendant still subsisted. Although the First Claimant transferred the benefit of the loan agreement to the Second Claimant, the linked debenture was not assigned at the same time, and was only transferred much later. Relying on the loan assignment, the Defendant lodged at Companies House a statement of satisfaction, asserting that the debenture had ceased to exist. The Claimants sought restoration of the debenture’s registration, whereas the Defendants contended that proprietary or promissory estoppel barred any reinstatement. The court decided there was no representation, assurance, or promise by the Claimants that the security would be treated as redeemed, ineffective, or left unenforced after the loan was...

Enforcement against those already identified as non-compliant is coming At a privacy conference in London, Information Commissioner John Edwards warned that action is imminent. “ Our bots are coming for your bots,” he said, describing a coding challenge his office launched on 28 February 2024 with external experts, using AI to scan websites and verify cookie banner compliance. Flagged earlier in 2024, the hackathon complements established enforcement. In November 2023, the ICO wrote to 53 of the largest websites with non-compliant cookie banners. By January 2024, the ICO said 38 had complied and four more would do so within a month. That figure has not shifted, Edwards added, and enforcement now awaits the remainder. Enforcement is coming for the rest, he confirmed......

Motoring Organisation Ltd v Spectrum Insurance Services Ltd [2024] EWHC 261 ( Comm) What are the practical implications of the case? This judgment explores a range of matters of genuine importance to commercial practice, notably the circumstances in which fiduciary duties might arise out of contractual negotiations, the extent of any such duties, and the potential for contractual liability to be implied from discussions concerning a merger. What was the background? Both companies provided insurance warranties for vehicles via motor dealerships. Their directors had previously worked together at a business named Warranty Holdings Ltd, and thereafter went on to create and develop separate, competing ventures. Between 2015 and 2019 there was an ongoing sequence of discussions and exchanges about potential co‑operation between the businesses, which culminated in a proposal that The Motoring Organisation ( TMO) would acquire a majority of Spectrum’s shares, although the exact terms of any...

What is the background consultation on the options for DB pension schemes? As one strand of the government’s push for economic growth under the Mansion House reforms (so called after the Mansion House speech on 10 July 2023, where the Chancellor of the Exchequer unveiled a package of pension measures to enhance member outcomes and strengthen UK capital markets), the DWP issued a call for evidence on 11 July 2023, ‘ Options for defined benefit pension schemes’. It sought to assess whether there is scope to permit greater flexibility in the investment of DB scheme assets so they can work harder for members, employers and the economy (with those assets amounting to about £1.7trn, roughly 75% of UK annual GDP). In particular, the exercise aimed to build an evidence base on ways DB pension schemes could deploy assets more flexibly, while keeping...

Libya v Ustay Yapi — CA Paris 23.01.2024 — RG No. 21/01507] What are the practical implications of this case? This ruling of the Court of Appeal is noteworthy for arbitration practitioners and their clients for two key reasons. First, it unequivocally reaffirms the function of the French courts as the annulment judge when seised under Article 1520-1 of the French Code of Civil Procedure (‘the arbitral tribunal wrongly upheld or declined jurisdiction’), addressing both the breadth and the depth of the annulment judge’s review of the award. Second, it offers additional clarity on the methodology employed by the French courts when testing this ground of annulment in the BIT context. Three points deserve emphasis: The scope of the review carried out by the annulment judge must not reach the merits. Doing so would equate to re-examining the arbitrators’...

Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each.
