Lucasfilm did not benefit in any way at Tyburn Film Productions Ltd's expense, counsel said to the appeals court there on 3 December 2025, in part because it already possessed rights over Cushing's likeness and an agreement and consent from the Cushing estate to 'resurrect' him as Grand Moff Tarkin. Tyburn contends it earlier made an agreement with the late actor then, at the time, granting the company a veto over any use of his image prior to his 1994 death. That contract concerns a TV series titled 'Heritage of Horror', which never aired. Tyburn further asserts the deal permits it to effectively 'resurrect' Cushing using stand-ins and CGI to ultimately finish the programme then if the actor were to die whilst filming remained in progress...

Irish telecom operator Eircom’s damages lawsuit against BT Group over a public-sector contract must be carefully managed to trial to deal with confidentiality issues and other matters, a UK judge told the parties today. At the High Court in London today, a judge said Eircom’s damages action against BT over a public-sector contract needs tight case management through to trial to address confidentiality and related concerns. Eircom brought the claim after Ofcom in 2020 penalised BT for its behaviour during a tender. Speaking to both sides, Judge Adam Johnson urged them to resolve any confidentiality flashpoints themselves and signalled he had no wish to step in unless it became unavoidable. He also expressed confidence that parties would do everything possible to keep confidential designations to a minimum, noting this was necessary to maintain control over the conduct of the trial. He framed this as the

Justice Richard Arnold granted AstraZeneca leave to appeal and permitted lorries carrying about 175,000 packs of Glenmark’s generics to move on to wholesalers, provided they did not reach pharmacy shelves while the case continued at any point during those interim proceedings. In this way, Glenmark could keep its first-to-market advantage, while causing only minimal detriment to AstraZeneca should the Court of Appeal later be persuaded to issue an injunction against supply. The judge said this approach maintained the status quo with the least possible prejudice to Glenmark’s position overall. The hearing was arranged at short notice, just days after the High Court refused AstraZeneca an injunction to block the diabetes generic from sale while the court considered whether the patents supporting the branded medicine were valid in law. Glenmark, Generics (UK) Ltd and Teva Pharmaceuticals have each begun proceedings in the UK to set...

Mergers Ofwat has published an updated approach to water and wastewater company mergers, alongside a refreshed statement of methods. This material sits within the special merger regime set out in the Water Industry Act 1991. Under that regime, the CMA may choose not to make a phase 2 reference in defined circumstances, having obtained Ofwat’s view on whether a transaction would impair its ability to make comparisons between water companies and whether any such harm is outweighed by relevant customer benefits. Ofwat first issued guidance on its mergers approach and methods statement in October 2015. Following a consultation in December 2024, Ofwat has revised this guidance so that it better mirrors the way recent mergers have been assessed and reflects changes in Ofwat’s price review methodology since 2015......

MSC Mediterranean Shipping Company SA v Conti 11 Container Schiffahrts- Gmb H & Co KG MS ‘ MSC Flaminia’ [2025] UKSC 14 Background The appeal arose from an explosion on the MSC Flaminia, a container vessel owned by Conti and operated by MSC under a time charter. The incident occurred in 2012 mid- Atlantic, causing fatalities, environmental contamination, and extensive damage to the ship. Conti commenced arbitration against MSC and obtained an award exceeding US$200 million. MSC subsequently sought to cap its liability under the 1976 Convention. The Supreme Court was asked to resolve two issues: whether the 1976 Convention allows a charterer to limit liability to the owner in respect of a claim for loss originally suffered by the owner the correct construction of Articles 2.1(a), (e) and (f) of the 1976...

After unveiling a pause to tariff hikes on Truth Social, President Donald Trump told reporters at the White House that he believes China wants to reach an agreement but is unsure how to proceed ( Pool via AP). On the platform, he said more than 75 nations had contacted US government officials to explore talks on tariff and non-tariff barriers, prompting him to implement a 90-day suspension of the higher reciprocal rates. Those increases had begun at 12:01am on Wednesday 9 April 2025... However, he noted the 10% global baseline levy on imports from all countries will remain in effect during the suspension. The executive order updating the reciprocal tariffs was not issued immediately. In his social media post, Trump added that increased tariff rates on China would apply at once, citing what he described as a lack of respect China has shown to the...

Glasgow City Council ( Respondent) v X ( Appellant) [2025] UKSC 13 Background This appeal addresses the extent of the interim obligation placed on local authorities in Scotland to arrange temporary housing for qualifying homeless persons. After asylum and refugee status were granted, the appellant and her family lost eligibility for Home Office accommodation. They thereby became homeless, and the duty to house them transferred to the respondent as the relevant local authority. The household comprises the appellant, her husband, and four children, including a son with autism and additional needs. In February 2021 the respondent secured temporary lodgings for the family under the mandatory interim duty in H( S) A 1987, s 29(1). The placement was a four-apartment dwelling (three bedrooms and a sitting room). Their permanent housing needs were later assessed as a five-apartment property to meet their son’s additional support needs. The...

Southern Electricity Power Distribution PLC v OCU Modus Ltd [2025] EWHC 723 ( TCC) What are the practical implications of this case? This judgment underlines that a range of elements, including non-pecuniary considerations, can influence how the court assesses damages for breach of contract where works are defective and there is a choice between remedial schemes. The usual position is that, if two alternative remedial options are equally effective and one costs less, then, prima facie, the claimant should implement the cheaper solution ( Mc Glinn v Waltham Contractors). Equally, if the claimant elects for a costlier route in that situation, that does not, of itself, render the decision unreasonable; however, the extra expenditure is generally treated as stemming from the claimant’s selection rather than the defendant’s wrongdoing ( Hirtenstein v Hill Dickinson). Here, the judge concluded there were only two viable methods to...

George Mantides Ltd v Revenue and Customs Commissioners [2025] UKUT 124 ( TCC) The Upper Tribunal endorsed His Majesty's Revenue and Customs' ( HMRC) view that locum doctor George Mantides was, in reality, an employee of the Royal Berkshire Hospital ( RBH), emphasising important contrasts with his separate engagement at Medway Maritime Hospital ( MMH). Tribunal Judges Thomas Scott and Jonathan Cannan reasoned that, whereas the MMH terms would have included a narrowly defined right to substitution, the RBH arrangement called for Mr Mantides' own services and offered no substitution right at all. On that footing, the tribunal determined there was a sufficient framework of control for the RBH engagement to be characterised as a contract of employment......

This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
