Lucasfilm did not benefit in any way at Tyburn Film Productions Ltd's expense, counsel said to the appeals court there on 3 December 2025, in part because it already possessed rights over Cushing's likeness and an agreement and consent from the Cushing estate to 'resurrect' him as Grand Moff Tarkin. Tyburn contends it earlier made an agreement with the late actor then, at the time, granting the company a veto over any use of his image prior to his 1994 death. That contract concerns a TV series titled 'Heritage of Horror', which never aired. Tyburn further asserts the deal permits it to effectively 'resurrect' Cushing using stand-ins and CGI to ultimately finish the programme then if the actor were to die whilst filming remained in progress...

Irish telecom operator Eircom’s damages lawsuit against BT Group over a public-sector contract must be carefully managed to trial to deal with confidentiality issues and other matters, a UK judge told the parties today. At the High Court in London today, a judge said Eircom’s damages action against BT over a public-sector contract needs tight case management through to trial to address confidentiality and related concerns. Eircom brought the claim after Ofcom in 2020 penalised BT for its behaviour during a tender. Speaking to both sides, Judge Adam Johnson urged them to resolve any confidentiality flashpoints themselves and signalled he had no wish to step in unless it became unavoidable. He also expressed confidence that parties would do everything possible to keep confidential designations to a minimum, noting this was necessary to maintain control over the conduct of the trial. He framed this as the

Justice Richard Arnold granted AstraZeneca leave to appeal and permitted lorries carrying about 175,000 packs of Glenmark’s generics to move on to wholesalers, provided they did not reach pharmacy shelves while the case continued at any point during those interim proceedings. In this way, Glenmark could keep its first-to-market advantage, while causing only minimal detriment to AstraZeneca should the Court of Appeal later be persuaded to issue an injunction against supply. The judge said this approach maintained the status quo with the least possible prejudice to Glenmark’s position overall. The hearing was arranged at short notice, just days after the High Court refused AstraZeneca an injunction to block the diabetes generic from sale while the court considered whether the patents supporting the branded medicine were valid in law. Glenmark, Generics (UK) Ltd and Teva Pharmaceuticals have each begun proceedings in the UK to set...

Easy Group Ltd v Easyfundraising Ltd and others [2024] EWHC 2323 ( Ch) What are the practical implications of this case? Family of marks A registered trade mark forming part of a wider family can enjoy increased distinctiveness, especially where uniform visual elements are deployed across that stable. Consistent presentation of colour scheme, typeface and scale reinforces recognition within the family of marks. Accordingly, brand owners should implement their brand guidelines without deviation when extending their trade mark portfolios, with the aim of fostering a strong, unified visual character. Delay in issuing proceedings When evaluating the head of damage to repute under a section 10(3) claim, the court is prepared to draw adverse inferences from any slowness by a claimant in taking enforcement steps. Here, the claimant had known of EFL’s supposed infringing conduct for a decade—said to erode the...

What are the practical implications of this case? The Court of Justice’s forthcoming judgment is poised to materially affect how EU Member States recognise works of applied art from non‑ EU jurisdictions under the EU’s harmonised copyright rules. If AG Szpunar’s reasoning is endorsed, EU copyright protection would extend to designers based outside the Union who place their creations on the EU market. Such a judgment could create a landmark for the treatment of international copyright within the EU, encouraging more uniform standards of protection across Member States and shaping practice worldwide. By setting out firmer guidance on safeguarding foreign works, the ruling could foster greater certainty and fairness in copyright enforcement. That, in turn, would support both creators and companies and help build a more coherent global copyright architecture. As current EU rules arguably leave the cross‑border reach of...

In mid- October 2024, the FCA flagged 38 concerns about social media profiles run by UK finfluencers that may feature illegal promotions, and it is questioning 20 of them under caution. Back in May 2024, the regulator stated it had brought charges against nine people linked to an unauthorised foreign exchange trading programme advertised online. According to Andrew Northage, a partner in the regulatory and compliance team at Walker Morris LLP, the FCA likely believed that the public attention from a case involving seven high-profile, UK-based defendants would serve as a warning; however, he added, such a warning is less likely to dissuade promoters and operators of illicit schemes located outside the UK, who know how hard it is for the FCA to pursue them. Overseas rules breaches The FCA’s guidance confirms that its social media financial promotion rules extend to overseas firms. These...

Antitrust Court of Justice dismisses Commission’s Intel appeal The Court of Justice delivered its judgment in Case C-240/22, Commission v Intel, an appeal directed at the General Court’s 2022 ruling in Case T-286/09 RENV (after referral back from the Court of Justice), which had partially overturned the Commission’s decision of 13 May 2009 finding an infringement and imposing a fine on Intel Corporation ( Intel) for alleged abuse of dominance involving conditional rebates and loyalty payments ( Case AT.37990). The Court of Justice dismissed the Commission’s appeal. Background In 2009, the Commission levied fines of €1.06bn on Intel (the Commission’s 2009 decision). It concluded that Intel had misused its dominant position in the x86 microprocessors market by awarding loyalty rebates to certain customers and to a distributor of desktop computers. First General Court appeal Intel challenged the Commission’s 2009 decision before the General Court. In 2014, the General Court...

Yangtze Navigation ( Asia) Co Ltd & another v TPT Shipping Ltd & others ( The Xing Zhi Hai) [2024] EWHC 2371 ( Comm) This decision reaffirms the settled position that courts are reluctant to let agency concepts supplant the doctrine of separate corporate personality, a defining feature of standard shipping company structures. It also addresses the practical challenge that can arise when a counterparty deals with an intermediary usually known to act for principals, but the capacity is unclear on this occasion. Background the dispute related to three consignments of logs carried from New Zealand to India the logs were produced by the third to fifth defendants (the Exporters), who executed Log Marketing and Sales Agency Agreements ( LMSAAs) with TPT Forests Ltd ( Forests) under those LMSAAs, Forests acted as the Exporters’ agent to market and sell their logs abroad....

This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
