Lucasfilm did not benefit in any way at Tyburn Film Productions Ltd's expense, counsel said to the appeals court there on 3 December 2025, in part because it already possessed rights over Cushing's likeness and an agreement and consent from the Cushing estate to 'resurrect' him as Grand Moff Tarkin. Tyburn contends it earlier made an agreement with the late actor then, at the time, granting the company a veto over any use of his image prior to his 1994 death. That contract concerns a TV series titled 'Heritage of Horror', which never aired. Tyburn further asserts the deal permits it to effectively 'resurrect' Cushing using stand-ins and CGI to ultimately finish the programme then if the actor were to die whilst filming remained in progress...

Irish telecom operator Eircom’s damages lawsuit against BT Group over a public-sector contract must be carefully managed to trial to deal with confidentiality issues and other matters, a UK judge told the parties today. At the High Court in London today, a judge said Eircom’s damages action against BT over a public-sector contract needs tight case management through to trial to address confidentiality and related concerns. Eircom brought the claim after Ofcom in 2020 penalised BT for its behaviour during a tender. Speaking to both sides, Judge Adam Johnson urged them to resolve any confidentiality flashpoints themselves and signalled he had no wish to step in unless it became unavoidable. He also expressed confidence that parties would do everything possible to keep confidential designations to a minimum, noting this was necessary to maintain control over the conduct of the trial. He framed this as the

Justice Richard Arnold granted AstraZeneca leave to appeal and permitted lorries carrying about 175,000 packs of Glenmark’s generics to move on to wholesalers, provided they did not reach pharmacy shelves while the case continued at any point during those interim proceedings. In this way, Glenmark could keep its first-to-market advantage, while causing only minimal detriment to AstraZeneca should the Court of Appeal later be persuaded to issue an injunction against supply. The judge said this approach maintained the status quo with the least possible prejudice to Glenmark’s position overall. The hearing was arranged at short notice, just days after the High Court refused AstraZeneca an injunction to block the diabetes generic from sale while the court considered whether the patents supporting the branded medicine were valid in law. Glenmark, Generics (UK) Ltd and Teva Pharmaceuticals have each begun proceedings in the UK to set...

In the EU’s lower-tier General Court, judges held that the Commission was entirely within its rights to classify Byte Dance as a gatekeeper, marking the first substantive ruling delivered under the new Digital Markets Act ( DMA). In a statement, the court said Byte Dance’s submissions lacked adequate and convincing evidence to clearly rebut the presumption that the company has a significant impact on the internal market, that Tik Tok serves as an important gateway enabling business users to reach their end users, and that Byte Dance holds an entrenched and durable position. In September 2023, the Tik Tok platform was labelled a core platform service, alongside other providers including Alphabet ( Google’s parent), Amazon, Apple, Meta Platforms and Microsoft......

Local authority licensing officers and lawyers can likely breathe a sigh of relief, as they no longer face the possibility—subject to any attempt by Uber to go to the Supreme Court, with the Court of Appeal having refused permission—that they must decide whether private hire vehicle operators are contracting with passengers, as the (now discharged) High Court declaration had required when interpreting LG( MP) A 1976, Pt II. Private hire vehicle operators remain free to enter agreements with drivers and with customers/passengers (who are not invariably the same party) in any manner allowed by law,...

Finanzamt T v S , Case C‑184/23 The taxpayer ( S) controlled a university medical department and a second company ( U). All entities formed a German VAT group. S was the controlling company of both entities within the German VAT group structure. U furnished S with services such as cleaning, linen care and passenger transport in relation to the university medical department building. That building was used for a blend of taxable commercial activities and non‑economic teaching functions. At first, the German tax authorities considered U’s supplies not subject to VAT because they were made within a VAT group. Nonetheless, it also maintained that, where the services related to the non‑economic teaching activities, a deemed supply of services arose as they had been carried out for non‑business purposes. This dispute had already been resolved by the Court of Justice in the...

High Court Judge David Foxton stated, in a judgment released on 16 July 2024, that a provision in an Amlin policy issued to Bintan Mining Corporation relieves the insurer of liability because the now-insolvent company failed to satisfy an arbitration award it owed. He found the wording of the 'pay first' clause (under which an insured must discharge sums due to a third party before seeking indemnity from its insurer) to be 'wholly unambiguous'. He rejected submissions that, as a matter of construction, the clause should not operate where a third party attempts to enforce rights under the policy. The case arises from King Trading Ltd’s 2017 charter of the vessel Solomon Trader to Bintan. The mining company obtained cover with Amlin the following year for charterers’ liability risks in relation to the vessel, which later ran aground in the Solomon Islands in 2019....

R ( Care Northeast) v Northumberland County Council 2024 EWHC 1370 ( Admin) What are the practical implications of this case? The court sets out a rigorous roadmap for how a public body should exercise discretionary decision-making. The judgment offers a careful analysis of the method to be adopted when exercising such discretion. First, define the issue it must resolve; next, make suitable enquiries to underpin the choice; finally, provide adequate justification for the outcome. The ruling will aid practitioners in scrutinising decision-making procedures and documenting the rationale for choices made under an authority’s discretion, prior to starting a challenge. It also promotes swift engagement and questions about whether a decision is lawful. Where determinations on public finances and budgets could be affected, virtually no delay will be tolerated if a claim seeks to quash the decision. This framework will help ensure decisions are...

This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
